"My 96 year-old mom just passed away recently--a Georgia resident. She had been in a nursing facility for about two years. Her only asset other than a tiny burial policy was her home, which probably has a current value of $35-40K.

What are the rules for recapture by Medicaid--I've heard differing versions. One says the first 25K is exempt from recapture, but another version is that if the value is over 25K at all, they claim the entire amount.

Aside from probating her simple will, are there any specific steps I need to take, especially with regard to Medicaid. I'm the executor--any special issues to watch out for or be aware of?"
